Sec. 3.101 Created
The building inspector shall be hired by the mayor with the approval of the council and shall continue to serve at the pleasure of the mayor and council.
Sec. 3.102 Appointment
The building inspector will be hired as an independent contractor or through an interlocal agreement with another city until such time as Oak Leaf can justify the hiring of a building inspector and implementing payroll.
Sec. 3.103 Duties
(a) General. The building inspector shall be authorized and directed to administer the building code, plumbing code, electrical code, housing code, zoning ordinance, and such other codes and ordinances as the council may from time to time specify. The building inspector shall have power as may be necessary in the interest of public health, safety, and general welfare to interpret and implement the provisions of said codes and ordinances, and shall have the authority to enter any building or premises within the city for the purpose of inspection or for the prevention of violations of the provisions of said codes and ordinances.
(b) Duties may include, but are not limited to, the following:
(1) Conduct on-site building structural, electrical, mechanical and plumbing inspections of existing buildings and throughout all phases of construction.
(2) Review, when requested by the planning and zoning committee, construction plans and specifications for compliance with city building codes and ordinances.
(3) Perform related duties as assigned.
(4) To conduct building, structural, electrical, mechanical, plumbing and certificate of occupancy inspections; to ensure compliance with applicable codes, ordinances and statutes; to provide city secretary with the information to maintain records of inspections; the planning and zoning committee through the council representative and/or secretary shall provide building code, statute and ordinance information to the building inspector.
(c) Supervision Received and Exercised.
(1) Receives general supervision from the planning and zoning council representative.
(2) Exercises no supervision of the personnel associated with the City of Oak Leaf.
Sec. 3.104 Liability
The building inspector shall not be personally liable while acting for the city, and he is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or permitted in the discharge of his official duties.
Sec. 3.105 Compensation
The building inspector will be hired as an independent contractor or city employee. The building inspector will receive compensation as approved by the city council.
Sec. 3.106 Qualifications
Knowledge of:
(1) Various materials used in construction and the approved uses of such materials.
(2) Various materials used in plumbing and electrical wiring installation and the approved uses of such materials.
(3) Principles of air conditioning and refrigeration.
(4) Appropriate foundations for various soil types.
(5) Modern construction methods and practices.
(6) Basic mathematical principles.
(7) Pertinent federal, state, and local laws, codes and regulations.
Sec. 3.107 Abilities
(a) Analyze construction, plumbing, electrical or mechanical problems; identify alternative solutions and project consequences of proposed actions.
(b) Communicate clearly and concisely, both orally and in writing.
(c) Establish and maintain cooperative working relationships with those contacted in the course of work.
(d) Interpret and apply federal, state and local policies, procedures, laws and regulations.
Sec. 3.108 Experience and Training Guidelines
Any combination of experience and training that would provide the required knowledge and abilities. A typical way to obtain the knowledge and abilities would be: Two years of increasingly responsible experience in performing building inspections or related work.
Sec. 3.109 Training
Equivalent to the completion of the twelfth grade. Additional specialized training in the construction trade or a related trade is desirable.
Sec. 3.110 License or Certificate
(a) Possession of an appropriate, valid Texas driver’s license.
(b) Possession of a State Plumbing Inspector’s license or Master Electrician’s license.
