Sec. 6.401Β Power to Define and Prohibit
The council shall have the power to abate and remove a nuisance and punish by fine the person responsible for the nuisance; to define and declare what constitutes a nuisance and authorize and direct the summary abatement of the nuisance within the city limits and within the cityβs extraterritorial jurisdiction; and to abate in any manner the city considers expedient any nuisance that may injure or affect the public health or comfort; as provided in Section 217.002, Local Government Code, which grants such powers and authorizes such acts, to police all areas or streets within the city. All powers granted under said section are specifically adopted and made a part hereof.
Sec. 6.402Β Conditions Enumerated*
(a)Β Burning Substances. Burning in the open of: hair, leather, rags, or other substances emitting an offensive, unhealthy, or annoying smell, smoke, or odor.
(b)Β Defecating, Etc., in Public Place. Defecating or urinating upon any public property or upon any place visible to persons in any public street or other public place or private residence.
(c)Β Fireworks. The sale or discharge of any fireworks within the jurisdiction of the city is prohibited.
(d)Β Garbage, Dumping, on Anotherβs Premises or Public Property. Throwing, putting or placing upon the premises of another any dung, feces, urine, or other unclean or filthy substance or liquid, trash, or other rubbish of any character, or dead animal, bird or fowl, or fragment thereof.
(e)Β Standing Water. The accumulation of water in which mosquito larvae breed.
(f)Β Lumber, junk, trash, or debris.
(g)Β Abandoned, discarded, or unused objects or equipment such as furniture, stoves, refrigerators, freezers, cans, tires or containers.
(h)Β The pollution of any stream, drain or tributary thereof.
(i)Β Other Acts. Any act or thing, not herein enumerated, which interferes with any personβs rights to be free from noxious and unpleasant noises and noxious odors, gasses, and vapors and from the sights of foul and offensive things and substances.
